Who you are dealing with

These terms are an agreement between you and Alfa Tech, Corp., Miami, FL 33177, United States (“GITECHY”, “we”, “us”). GITECHY™ is a brand of Alfa Tech, Corp. used for its software products. Contact: info@gitechy.com.

Subscriptions and licenses

Plans are billed monthly or yearly in advance and renew automatically until cancelled. Each license may be active on one website at a time.

Use of the software

The plugins are licensed under the GPL. Your subscription gives you license keys, updates, hosted services (if purchased) and support while it is active.

Hosted services

For hosted plans we provide the service with reasonable care. See “Your data and backups” below.

Cancellation

You can cancel any time in My account; the plan stays active until the end of the paid period.

Hosted sites after the end of a subscription

When a hosted subscription ends and is not renewed, the apps are read-only for 30 days and then switched off. The hosted site and all data stored in it are kept for 90 days after the end and then permanently deleted. We remind you by email at the end, 30 days and 7 days before the deletion date. You can download a backup at any time before that date.

Storage

Hosted plans include the storage shown on the pricing page; extra storage is available as add-on packs. When the storage is full, new files cannot be saved until storage is added or files are deleted; existing data is not affected.

Business use

GITECHY products are intended for businesses and professionals. By purchasing, you confirm that you are acting for business purposes.

No warranty

The software and the hosted services are provided “as is” and “as available”. We work hard to keep them reliable, but we do not guarantee that they will be uninterrupted or error-free, or that they will meet every requirement you have. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Your data and backups

GITECHY is not responsible for any loss, damage or corruption of data, however it happens – including software errors, updates, server or hosting failures, cloud storage problems, security incidents, deleted accounts or sites, ended subscriptions, or actions by you, your users or third parties.

You are solely responsible for making and keeping your own backups of all your data, regularly and in a place other than the website. This applies to the WordPress plugin and to hosted plans alike:

• WordPress plugin: your website, hosting, database, files, security and backups are entirely your responsibility.
• Hosted plans: download your backups regularly (Settings → Backup) and keep them safe. Any backups GITECHY makes of hosted sites are only for running the service, are not guaranteed and do not replace your own backups.

You also remain responsible for the content and personal data you store and for complying with the laws that apply to them.

Third-party services

Some features rely on services we do not control, such as payment providers (e.g. Stripe, PayPal), email providers (SMTP, Google, Microsoft 365), cloud storage, remote-support tools (e.g. RustDesk) and social networks. We are not responsible for their availability, changes, fees or actions, or for emails being filtered as spam by the receiving server.

Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, revenue, business, goodwill or data, or the cost of replacement services – even if we were told such damages were possible.
• Our total liability for all claims relating to the products or these terms is limited to the amount you paid us for the affected product in the 12 months before the event that gave rise to the claim.
• These limits do not apply where the law does not allow them, for example to damages caused by our gross negligence or wilful misconduct.

Indemnification

You agree to defend and hold GITECHY harmless from claims by third parties arising from your content, your use of the products in violation of these terms or the law, or the data of your customers that you process with the products.

Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of hosting or internet providers, natural disasters or actions of authorities.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Disputes will be handled by the state or federal courts located in Florida, United States, unless the law where you live requires otherwise.
